Terms and conditions
§ 1 Scope and parties
These terms govern the relationship between parents/legal guardians ("client") and Linn-Marie Gollner, represented by her legal guardian Manuel Gollner, Tattenbachstraße 10, 80538 München, Germany ("provider"), for all babysitting and childcare services.
§ 2 Formation of contract
Requests via web form, email, or phone do not constitute a contract. The contract is concluded only when we confirm your request in writing (email counts). Only then is the date booked.
§ 3 Scope of services
- Classic babysitting at your place
- Drop-off care at our home in München-Lehel (fenced yard, max. 4 children at once, an adult of the provider household always reachable in the house)
- Event childcare for weddings, parties, etc.
- Birthday hosting (games, crafts, treasure hunts) — the birthday child's parents remain primary supervisors
Optional and free of charge: live location via WhatsApp or "Find My", photo/day updates, a short report after the session. These are voluntary, not contractually owed.
§ 4 Age, child labour law, and representation
Linn-Marie is 14 years old and personally handles all regular babysitting bookings. Per German youth employment protection law (JArbSchG), her sessions take place only during permitted hours (generally during the day, until 6 p.m. at the latest).
For larger assignments (birthday parties with many kids, event or wedding childcare) or sessions outside that window, Linn-Marie brings backup — either her brothers Finn (16) or Joel (18), or one of her friends from her babysitter network. We transparently communicate who is coming before each booking.
§ 5 Prices and payment
Prices are agreed individually per request and confirmed in writing before contract conclusion. Hourly billing is standard; flat fees are possible for events.
Payment in cash after the session or by bank transfer within 7 days.
Receipt / tax: we issue a receipt on request. For tax deductibility as household-related services (§ 35a EStG), bank transfer is required — cash payment is not accepted by the German tax authority.
§ 6 Cancellation
- More than 24 h before the start: free.
- Less than 24 h: 50 % of the agreed fee.
- No-show or on-site cancellation: 100 % of the agreed fee.
- Child illness or force majeure: case-by-case agreement, usually free.
Cancellation by the provider (e.g. own illness) is possible at any time without fee. We will try to provide a substitute from within the family in such cases.
§ 7 Client obligations
- Provide complete and accurate information about your child (allergies, medications, sleep times, emergency contacts).
- Be reachable by phone during the session.
- For daycare / school pick-up: written authorization for the institution.
In an emergency, we notify you immediately. If unreachable, we act with due care (calling emergency services if necessary).
§ 8 Supervision and liability
We supervise your child to the best of our knowledge and judgement. Paediatric first-aid and babysitter courses are completed and refreshed regularly.
Liability insurance: private liability insurance is in place. We clarify the insurance situation jointly before the first booking and provide written confirmation upon request.
We are liable without limitation for intent and gross negligence; for slight negligence only insofar as essential contractual duties are concerned and the damage was foreseeable at contract conclusion. Liability for indirect damages and lost profits is excluded to the extent legally permissible.
We do not assume liability for damages caused by the child itself; your own liability insurance applies.
§ 9 Confidentiality
All family information is treated confidentially and not shared with third parties, except in emergencies or where required by law.
§ 10 Data protection
Personal data is processed in accordance with our privacy policy.
§ 11 Final provisions
German law applies. Place of jurisdiction for merchants is München. If individual provisions are invalid, the rest of the contract remains effective.
